REGULATIONS ON THE LABOR MANAGEMENT OF THE FOREIGN-FUNDED ENTERPRISES PDF Print E-mail

Article 1 The regulations are formulated in line with State laws and administrative regulations to guarantee the legal rights and interests of the foreign-funded enterprises (FFEs) and their employees and establish, maintain and develop stable and harmonious relations between the FFEs and the employees.

Article 2 The regulations are applied to the Sino-foreign joint equity ventures, Sino-foreign cooperative ventures, solely foreign-funded enterprises and Sino-foreign limited companies established within the People's Republic of China and their employees.

Article 3 The labor administrative departments of the people's governments at county and above level exercise supervision over the FFEs in accordance with this set of regulations with regard to their use and training of personnel, and the personnel's wages, insurance and welfare, as well as their working safety and hygiene conditions.

Article 4 The statute and system of the FFEs must not go against the State laws and administrative regulations.

Article 5 The FFEs may decide by themselves the time, conditions and ways of the employment and the number of personnel they employ in line with relevant State laws and administrative regulations.

The FFEs may recruit employees from the employment services which have confirmed by the labor department at the localities of the FFEs but under the approval of the labor administrative departments may also recruit their employees directly or from other regions.

The FFEs must not recruit the employees who are still employed by other employers and are forbidden to use child laborers.

(Adopted at the 15th Meeting of the Standing Committee of the Tenth National People’s Congress on April 27, 2005)

At its 15th Meeting, the Standing Committee of the Tenth National People’s Congress discussed the State Council’s Proposal for Giving an Interpretation to the Second Paragraph in Article 53 of the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China. After consulted its Committee for the Basic Law of the Hong Kong Special Administrative Region, the Standing Committee of the National People’s Congress, in accordance with the provisions of the fourth paragraph in Article 67 of the Constitution of the People’s Republic of China and the first paragraph in Article 158 of the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China, gives the following interpretation to the provisions of the second paragraph in Article 53 of the Basic Law of the Hong Kong Special Administrative Region of the People’ s Republic of China:

Measures for Election and Decision on Appointments for the Third Session of the Tenth National People's Congress PDF Print E-mail

(Adopted at the Third Session of the Tenth National People’s Congress on March 8, 2005)

Pursuant to the provisions of the Constitution of the People’s Republic of China and the relevant laws, the Measures for Election and Decision on Appointments for the current session are formulated.

1. The Third Session of the Tenth National People’s Congress shall elect the Chairman of the Central Military Commission of the People’s Republic of China, decide on the choices for the other component members of the Central Military Commission of the People’s Republic of China and hold a by-election for the members of the Standing Committee of the Tenth National People’s Congress.

At its 18th Meeting, the Standing Committee of the Tenth National People’s Congress decides to add a national law to the list of the national laws in Annex III to the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China, i.e., the Law of the People’s Republic of China on Judicial Immunity from Compulsory Measures Concerning the Property of Foreign Central Banks.

Order of the President of the People’s Republic of China No. 53

The Law of the People’s Republic of China on Supervision by the Standing Committees of the People’s Congresses at All Levels, adopted at the 23rd Meeting of the Standing Committee of the Tenth National People’s Congress of the People’s Republic of China on August 27, 2006, is hereby promulgated and shall go into effect as of January 1, 2007.
